In these Terms and Conditions, GENTEK EOOD may also be referred to as “Balkan Titles”, “we”, “us”, “our” or “the Seller”.
A person who uses the website or places an order may be referred to as “you”, “the Customer” or “the User”.
A “Consumer” is a natural person acting for purposes outside their trade, business, craft or profession.
2. Scope of These Terms
These Terms and Conditions apply to:
Access to and use of the website;
Orders submitted through the online shop;
Digital certificates;
Printed certificates;
Personalised products;
Gift wrapping and related options;
Communications between the Customer and Balkan Titles;
Delivery, cancellation, complaints and refunds.
Any individual terms expressly agreed between us and a Customer will take precedence over these general Terms and Conditions where they conflict.
3. Nature of the Products
Balkan Titles offers souvenir and gift products associated with the symbolic ownership of a specified area of land in Bulgaria.
Depending on the selected product, the Customer may receive:
A personalised digital certificate;
A personalised printed certificate;
Information or a link showing the location associated with the certificate;
Gift wrapping or other optional presentation materials.
Product options, formats, sizes, personalisation fields, prices and availability are shown on the relevant product page.
4. Important Notice: Symbolic Ownership Only
Products sold by Balkan Titles are symbolic souvenir gifts.
A Balkan Titles certificate:
Is not a notarial deed;
Is not an official title deed;
Is not an entry in the Bulgarian Property Register;
Does not transfer registered ownership of immovable property;
Does not create a real property right;
Does not create a right to build on, occupy, lease, sell, mortgage or commercially exploit land;
Does not provide hunting, fishing, farming, mineral, water, timber or access rights;
Does not grant citizenship, residency, nobility, aristocratic status, political status or any official title;
Must not be presented as legally recognised proof of ownership.
The certificate is intended solely as a commemorative, symbolic and decorative product.
References on the website to “your land”, “ownership”, “your plot”, “landowner” or similar expressions must be understood in this symbolic souvenir context.
The location supplied with the certificate identifies the area associated with the symbolic gift. It does not constitute a cadastral plan, legally binding boundary, surveyor’s report or proof of registered ownership.
5. Visiting the Location
Any visit to the location associated with a certificate is undertaken entirely at the visitor’s own discretion and risk.
The certificate does not automatically grant a right of physical access to any land. Access may be affected by:
Private property boundaries;
Public-access restrictions;
Agricultural activity;
Natural conditions;
Roads and infrastructure;
Local regulations;
Seasonal or safety restrictions.
Customers and visitors must comply with all applicable laws, signs, access restrictions and instructions from landowners, occupiers and public authorities.
Balkan Titles does not guarantee that a particular location will be physically accessible or suitable for visiting.
The Customer must not plant objects, flags, signs, trees or other items, remove anything from the location, conduct commercial activities or alter the land without the express permission of the legally entitled owner and any necessary authority.
6. Product Information and Images
We make reasonable efforts to ensure that product descriptions, images, dimensions, formats and other information are accurate.
However:
Images may be illustrative;
Colours may vary depending on screen and printing settings;
Packaging and presentation may differ slightly from website images;
Maps and location services supplied by third parties may change;
Minor variations that do not affect the essential characteristics of the product may occur.
Such minor differences do not constitute a defect where the product otherwise conforms to the contract.
The product description displayed when the order is placed forms part of the contract.
7. Eligibility to Place an Order
To place an order, you must:
Be at least 18 years old; or
Have the permission and supervision of a parent or legal guardian;
Have the legal capacity to enter into a binding contract;
Provide complete and accurate information;
Be authorised to use the selected payment method.
We may refuse or cancel an order where we reasonably believe that:
The Customer lacks legal capacity;
The order involves fraud or unauthorised payment;
Incorrect or misleading information has been supplied;
The order violates these Terms and Conditions or applicable law.
8. Personalisation Information
Customers are responsible for checking all information submitted for personalisation before completing an order.
This includes:
Names;
Titles;
Dates;
Dedications;
Messages;
Spelling;
Capitalisation;
Punctuation;
Selected certificate size or format;
Delivery details.
Personalised products may be produced using the information exactly as submitted by the Customer.
Balkan Titles is not responsible for errors caused by incorrect, incomplete or misspelled information supplied by the Customer.
Where possible, we may agree to correct personalisation information if the request is received before production begins. We cannot guarantee that changes will be possible after an order has been submitted.
Requests should be sent promptly to info@balkantitles.com, quoting the order number.
9. Prohibited Personalisation Content
You must not submit personalisation content that:
Is unlawful, fraudulent, threatening, defamatory or discriminatory;
Infringes intellectual property, privacy or other third-party rights;
Contains obscene, hateful or abusive material;
Impersonates another person or organisation;
Falsely suggests legal ownership, authority or official recognition;
Is intended to deceive another person;
Promotes criminal or harmful conduct.
We may refuse, suspend or cancel an order containing prohibited content.
Where an order is cancelled for this reason before production, any payment received will normally be refunded using the original payment method, except for reasonable costs already incurred where permitted by law.
10. Ordering Process
Products can be selected and added to the shopping cart through the website.
Before submitting an order, the Customer can review and, where available, correct:
Selected products;
Product quantities;
Personalisation information;
Billing information;
Delivery information;
Delivery method;
Total price.
An order is submitted when the Customer completes the checkout process and activates the button confirming an obligation to pay.
After an order is submitted, we may send an automated acknowledgement to the email address supplied by the Customer.
An automated acknowledgement confirms that we have received the order. It does not necessarily mean that the order has been accepted.
11. Formation of the Contract
A binding purchase contract is formed when:
We expressly confirm acceptance of the order;
We dispatch the printed product; or
We make the digital product available to the Customer,
whichever occurs first.
We may reject an order before acceptance where:
A product is unavailable;
The displayed price contains an obvious error;
Payment has not been authorised;
Required personalisation information is missing;
Delivery to the requested destination is unavailable;
We reasonably suspect fraud, misuse or unlawful activity;
The order cannot be fulfilled for technical or operational reasons.
Where payment has already been received for an order that we reject, the relevant amount will be refunded.
12. Prices and Taxes
Prices are displayed on the website in the currency indicated during checkout.
Unless stated otherwise, prices include any VAT that must be charged under applicable law.
Delivery fees, gift-wrapping costs and other additional charges are displayed before the Customer submits the order.
The final amount payable is shown at checkout.
Customers outside Bulgaria may be responsible for local:
Import duties;
Customs charges;
Taxes;
Handling fees;
Clearance costs.
Unless expressly stated otherwise, these charges are not included in the product or delivery price and are the Customer’s responsibility.
13. Pricing Errors
We take reasonable care to display accurate prices. However, errors may occasionally occur.
Where an obvious pricing error is discovered before the contract is formed, we may cancel the order or contact the Customer to offer the product at the correct price.
Where an obvious pricing error is discovered after a contract has been formed, we will handle the matter in accordance with applicable consumer law.
14. Payment
Available payment methods are displayed during checkout.
Payment may be processed by an independent payment-service provider. The provider may apply its own terms and privacy policy.
The Customer confirms that:
The payment details supplied are correct;
The Customer is authorised to use the payment method;
Sufficient funds or credit are available.
We do not normally receive or store complete payment-card details.
An order may be delayed or cancelled if payment is refused, reversed, flagged for review or not completed.
15. Digital Certificates
Digital certificates are supplied electronically, normally through:
A download page;
A link shown after checkout;
An email;
The Customer’s online account, where available.
The Customer is responsible for:
Providing a valid email address;
Checking spam and junk folders;
Ensuring that their device can open the supplied file format;
Downloading and securely storing the file.
Unless expressly stated otherwise, purchasing a digital certificate grants the Customer a personal, non-exclusive, non-transferable licence to download, store and print the certificate for private, non-commercial use.
The Customer must not:
Resell the digital file;
Distribute copies commercially;
Remove branding or notices;
Modify the certificate to imply legal ownership or official status;
Use the certificate for fraud, misrepresentation or unlawful purposes.
16. Express Supply of Digital Content
Where a digital certificate is made available before the expiry of the statutory withdrawal period, the Customer may be asked during checkout to:
Expressly consent to immediate performance of the contract; and
Acknowledge that the statutory right of withdrawal is lost once supply of the digital content has begun.
Where these requirements are validly satisfied, the Customer will not have a right to withdraw merely because they change their mind after access to or download of the digital certificate has begun.
This does not affect the Customer’s legal rights where the digital content is defective, incorrectly supplied or does not conform to the contract.
17. Printed Certificates
Printed certificates are prepared using the personalisation information submitted with the order.
Production begins after the order and payment have been accepted, unless stated otherwise.
Any production estimate displayed on the website is indicative and may vary depending on:
Order volume;
Personalisation requirements;
Printing availability;
Public holidays;
Technical issues;
Events outside our reasonable control.
Once a personalised printed product has entered production, changes or cancellations may no longer be possible.
18. Delivery
Printed products are delivered to the address supplied during checkout.
The Customer is responsible for ensuring that the recipient’s:
Name;
Address;
Postal code;
Country;
Telephone number;
Other required delivery details
are complete and accurate.
Delivery methods, estimated delivery periods and charges are displayed during checkout where available.
Delivery estimates are not guaranteed delivery dates unless we expressly agree otherwise in writing.
19. Delivery Delays
We are not responsible for delays caused by circumstances outside our reasonable control, including:
Postal or courier disruption;
Customs processing;
Incorrect delivery information;
Severe weather;
Natural disasters;
Strikes;
Transport disruption;
Border restrictions;
Government action;
Technical failures;
Peak seasonal demand.
Where a delay occurs, we will take reasonable steps to provide available information and assist the Customer.
Mandatory consumer rights relating to delivery remain unaffected.
20. Failed Delivery and Incorrect Address
Where delivery cannot be completed because the Customer supplied incorrect or incomplete information, failed to accept delivery or failed to collect the shipment, the product may be returned to us.
We may require payment of reasonable additional delivery costs before sending the product again.
Personalised products returned because of an incorrect address are not automatically eligible for a refund.
21. Risk and Ownership of Physical Products
Risk of loss or damage to a physical product passes to a Consumer when the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of it.
Ownership of the physical certificate and packaging passes after full payment and delivery.
Ownership of the physical certificate does not create or transfer legal ownership of land.
22. Consumer Right of Withdrawal
Consumers who purchase eligible products online generally have the right to withdraw from the distance contract within 14 days without giving a reason.
For goods, the withdrawal period generally expires 14 days after the day on which the Consumer, or a third party designated by the Consumer other than the carrier, receives the goods.
To exercise the right of withdrawal, the Consumer must send a clear statement of their decision to withdraw to:
GENTEK EOOD
35A Kazbek Street
Manastirski Livadi – West
Vitosha District
1618 Sofia
Bulgaria
Email: info@balkantitles.com
The Consumer may use the model withdrawal form at the end of these Terms, but its use is not mandatory.
The withdrawal communication must be sent before the withdrawal period expires.
23. Exceptions to the Right of Withdrawal
The statutory right of withdrawal does not apply in cases provided by law, including:
23.1. Personalised products
The right of withdrawal does not apply to goods made to the Consumer’s specifications or clearly personalised.
This normally includes printed certificates prepared with a Customer-selected:
Name;
Date;
Dedication;
Message;
Title;
Location choice;
Other individual information or design selection.
A personalised product cannot normally be returned merely because the Customer changes their mind.
23.2. Digital content
The right of withdrawal may be lost for digital content not supplied on a physical medium where:
Performance began with the Consumer’s prior express consent;
The Consumer acknowledged that the right of withdrawal would be lost; and
The legally required confirmation was supplied.
These exceptions do not limit the Consumer’s rights where a product is defective, damaged, incorrectly produced or does not conform to the contract.
24. Returns of Eligible Non-Personalised Goods
Where the right of withdrawal applies, the Consumer must return the goods without undue delay and no later than 14 days after communicating the withdrawal.
Unless we agree otherwise, the Consumer bears the direct cost of returning the goods.
Returned goods should be appropriately packaged to prevent damage during transport.
The Consumer is responsible only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
The return address and any applicable return instructions will be provided after the withdrawal request is received.
25. Refunds Following Withdrawal
Where a valid right of withdrawal is exercised, we will refund payments received for the relevant goods, including the cost of the least expensive standard delivery method offered by us, where required by law.
Additional delivery costs resulting from the Customer’s choice of a more expensive delivery method are not refundable to the extent permitted by law.
Refunds will be made without undue delay and no later than 14 days after we are informed of the withdrawal.
For physical goods, we may withhold the refund until:
We receive the returned goods; or
The Consumer provides evidence that the goods have been sent back,
whichever occurs first.
Refunds are normally issued through the same payment method used for the original transaction unless expressly agreed otherwise.
26. Damaged, Incorrect or Defective Products
Customers should inspect printed products after delivery.
Where a product arrives:
Damaged;
Incorrectly printed due to our error;
Different from the product ordered;
Incomplete;
Otherwise not in conformity with the contract,
the Customer should contact us at info@balkantitles.com and provide:
The order number;
A description of the problem;
Clear photographs, where relevant;
Any other information reasonably required to investigate the issue.
Customers should report visible transport damage as soon as reasonably possible. A delay in reporting does not remove mandatory statutory rights.
Where a complaint is justified, available remedies may include repair, replacement, price reduction or termination and refund, in accordance with applicable law.
27. Errors in Personalised Products
Where the final product reproduces the personalisation information exactly as submitted by the Customer, spelling or content mistakes supplied by the Customer do not constitute a product defect.
Where the mistake was caused by Balkan Titles, we will provide an appropriate remedy in accordance with applicable law.
28. Legal Guarantee and Conformity
Consumer products and digital content must conform to the contract and applicable legal requirements.
Nothing in these Terms limits or excludes the Consumer’s mandatory statutory rights relating to conformity, defects, repairs, replacement, price reduction, contract termination or refunds.
Any commercial guarantee offered on a product page is additional to, and does not replace, mandatory legal rights.
29. Promotions and Discount Codes
Promotional offers and discount codes may be subject to additional conditions displayed with the promotion.
Unless otherwise stated:
Codes cannot be exchanged for cash;
Codes cannot be used after expiry;
Only one code may be used per order;
Codes cannot be applied retrospectively;
Codes may apply only to selected products or customers;
Delivery charges may be excluded;
Promotions may not be combined.
We may cancel or restrict a promotion in cases of fraud, technical error, misuse or circumstances outside our reasonable control, without affecting orders already validly accepted.
30. Customer Accounts
Where account registration is available, Customers are responsible for:
Keeping login details confidential;
Providing accurate account information;
Informing us of suspected unauthorised access;
Activities conducted through their account where caused by their failure to protect access credentials.
We may suspend or close an account where it is used unlawfully, fraudulently or in violation of these Terms.
31. Intellectual Property
The website and its content, including:

are owned by or licensed to GENTEK EOOD and are protected by applicable intellectual-property laws.
Except as expressly permitted, Users must not copy, reproduce, modify, distribute, publish, sell, licence, scrape or commercially exploit website content without prior written permission.
Purchasing a product does not transfer intellectual-property rights in the certificate template, design, branding or website content.
32. Permitted Use of the Website
The website may be used only for lawful purposes.
Users must not:
Attempt unauthorised access to the website or its systems;
Introduce malware or harmful code;

Use false identities or payment information;

33. Third-Party Services and Links
The website may use or link to services operated by third parties, including:
Payment providers;
Courier companies;
Mapping services;
Social networks;
Analytics providers;

Third-party services are governed by their own terms and privacy policies.
We are not responsible for the availability, content, accuracy or independent conduct of third-party services, except where responsibility cannot legally be excluded.
34. Maps and Location Information
Location information may be displayed through third-party mapping services.
Maps, coordinates and links are provided for general identification and souvenir purposes only.
They must not be relied upon as:
Legal boundary records;
Cadastral data;
Survey information;
Navigation or safety advice;
Evidence of access rights;
Evidence of legal ownership.
We do not control changes made by third-party mapping providers.
35. Reviews and User Content
Where Customers submit reviews, photographs or other content, they confirm that:
The content is accurate and lawful;
They have the right to submit it;
It does not infringe another person’s rights;
It does not contain confidential or prohibited information.
The Customer grants us a non-exclusive, worldwide, royalty-free licence to display, reproduce and use the submitted content for operating and promoting the business, unless otherwise agreed.
We may remove content that is unlawful, misleading, abusive, irrelevant or infringes third-party rights.
We will not suppress or manipulate genuine consumer reviews in violation of applicable law.
36. Limitation of Liability
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for:
Death or personal injury caused by negligence;
Fraud or fraudulent misrepresentation;
Intentional misconduct or gross negligence where applicable;
Breach of mandatory consumer rights;
Any other liability that cannot lawfully be excluded.
Subject to these limitations, Balkan Titles is not responsible for:
Loss caused by incorrect information supplied by the Customer;
Inability to access a location associated with a certificate;
Reliance on a symbolic certificate as proof of legal ownership;
Third-party mapping inaccuracies;
Delays caused by postal, courier, customs or force majeure events;
Indirect or unforeseeable loss;
Business loss suffered by Consumers purchasing for personal purposes;
Loss caused by unlawful or unauthorised use of the product.
For Customers acting in the course of business, our aggregate liability relating to an order will not exceed the amount paid for that order, except where a higher liability is required by law.
37. Indemnity for Unlawful Use
To the extent permitted by law, a User acting for business purposes agrees to compensate GENTEK EOOD for losses, liabilities and reasonable costs resulting from:
Unlawful use of the website;
Fraudulent misrepresentation of a certificate;
Infringement of third-party rights;
Personalisation content supplied by that User;
Material breach of these Terms.
This clause does not apply to Consumers to the extent that it would restrict mandatory consumer rights.
38. Events Outside Our Control
We are not liable for failure or delay caused by events outside our reasonable control, including:
Natural disasters;
Fire or flood;
War, terrorism or civil disorder;
Epidemics or public-health restrictions;
Government action;
Labour disputes;
Transport disruption;
Postal or courier failures;
Internet or telecommunications failure;
Cyberattacks;
Utility outages;
Supplier failure.
We will take reasonable steps to reduce the effect of such events and resume performance where possible.
39. Privacy and Personal Data
Personal data is processed in accordance with our Privacy Policy and Cookie Policy.
Customers who provide another person’s information for a personalised gift confirm that they are authorised to provide that information for the purpose of creating and delivering the product.
40. Electronic Communications
By placing an order, the Customer agrees that contractual information, invoices, confirmations and other communications may be supplied electronically to the email address provided.
The Customer is responsible for keeping their email address accurate and accessible.

43. Governing Law
These Terms and Conditions and contracts concluded through the website are governed by the laws of the Republic of Bulgaria.
Where the Customer is a Consumer habitually resident in another country, this choice of law does not deprive the Consumer of the protection provided by mandatory provisions of the law that would otherwise apply.
44. Jurisdiction
Disputes will be submitted to the competent Bulgarian courts unless mandatory consumer law permits the Consumer to bring proceedings before the courts of another jurisdiction.
Nothing in this clause limits a Consumer’s right to use any competent court available under applicable law.
45. Severability
If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect.
The invalid provision will be interpreted or replaced, where legally possible, with a valid provision that most closely reflects its intended commercial purpose.
46. No Waiver
Failure to enforce a right under these Terms does not constitute a waiver of that right.
A waiver is effective only where expressly made in writing.
47. Transfer of Rights
We may transfer our rights and obligations under a contract as part of a merger, restructuring, sale of business or similar transaction, provided this does not reduce the Customer’s legal rights.
Consumers may transfer their contractual rights only where permitted by law or with our prior written agreement.
48. Changes to These Terms
We may update these Terms and Conditions to reflect changes in:
Applicable law;
Our products or services;
